International container transport by sea is an important method of carriage of goods by sea. Although the original transport legal system has not been objectively changed by the occurrence and development of container transport, the shipping transport practice and relevant legal system has already been influenced by the physical nature of container transport, and many new legal problems on maritime law have arisen. By discussing the shipping and judicial practice in China, the author starts with the container transport participants' legal status and the period of carrier responsibility, and then specifically analyzes the carrier's liability in international container transport by sea with the relevant provisions in domestic law and certain international conventions, in order to solve the problem of carrier's liability in theory and in practice, to accelerate development of container transport, and to give help to practitioners in maritime fields.This article is composed of 3 chapters besides the foreword and the conclusion. Chapter one is an analysis concerning the carrier and participants involved in international container transport by sea with relevant provisions in relation to conventions, UNCITRAL Transport Law Draft convention on the carriage of goods [wholly or partly] [by sea], CMC, and comparing with actual carrier, maritime performing party, freight forwarding, NVOCC, MTO. Chapter two is an analysis concerning the period of carrier responsibility with relevant provisions in the law abovementioned and bill of ladings, and comparing with the methods of the handover of container goods. Chapter three is the key point of this article by emphasizing the carrier's liability in international container transport by sea, and is focus on Unknown Clause and the Concealed Damage of containerized goods.
