On Bribe

This paper has analyzed the invasion of the bribe against object of crime, through analyzing the process of the invasion, the writer has proposed the essence of the bribe crime. The bribe should not only be limited in the physical benefit, but also the non-physical benefit.However, the Chinese criminal law has considered the bribe as the property. The regulation has its own reasons, it has been advanced in history, but the regulation has not been fit to the development of the society.We have to explain the criminal law under the forecast of the citizens. We must abide the way when we explain the"property"in the criminal law. Under the current criminal law, the"property"can include the physical benefit, other than the non-physical benefit.At last, the writer has analyzed two difficult problems in the judicature circumstance, which are"sex bribe"and the"courtesy demands reciprocity".and the writer has also given his answer to the problems.
