By means of reflecting on the theory of natural rights, the author tries to prove that, although the conclusion of natural rights is of value, the theory is insufficient to provide forceful explanation for the source and basis of human rights. Human rights could not be transcendental. Like our other system, human rights base on people's practice, on the choice of social intercourse, and on the relation between government and its people. The reason of the globalization of human rights is that human rights correspond to the nature of human being, affirm the value of human being and own solidly substantial basis.From the respect of history, the article studies the historical reason of the globalization of human rights since the Second World War. After evaluating several important international human rights treaties, such as the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights, and the ECHR, the author tries to pose three points. The first, displaying the historical rationality of the globalization of human rights; the second, revealing that the human rights will develop in the dialogues and conflicts of multiple culture; the third, stressing that China should pay enough attention to the object basis of the globalization of human rights.With the foundation of the first two parts, the author gets the conclusion in the third part. In the third part, the article depicts the historical picture of Chinese human rights, exemplifies the weak points in the field of Chinese human rights, and appeals for liberalizing our thinking and renewing our notion. At last, the author stresses the importance of the universality in the field of human rights, the necessities of the objection of the new interventionism, and the inevitability of constructing Chinese human rights on the reality of China and the world.
