Protection Of Computer Software In A Special Law

I want to write this thesis to explain how to protect computer software underintellectual property law. Many countries have different points on the protected modeand the protective range of computer software and so on. The classification ofprotection mode of computer software is written.Almost of counties in the world use dispersive mode to protect software, but it is notthe best mode. There are several levels legislation to protect computer software inChina. However, they cannot protect computer software correctly. The protection ofsoftware has some negative impacts on the system of copyright law. The author wantto make use of legislation to improve our computer software industry of China.This thesis consists of four parts. In the first section development of computersoftware in the international countries is depicted. Then the disadvantages ofprotection of computer software in China are discussed and ways to improve it aregiven out at the same time.In the second section, the author discuss about the advantages and disadvantages ofprotection of computer software in trade secret law, copyright law and patent law.In the third section, the author introduce software legislation in nomology. Theauthor introduce from the first choice to the second choice and from pursuingefficiency to pursuing justice. The author introduce the value and made our knowefficient paths and easy choices of protecting software legislation in a special law.In the fourth section, the author introduce theoretical overview of software right in aspecial law. The author create software right which keep balance with copyright andpatent right and introduce legislation advises. For example, Legislation principle ofsoftware right will embody balance of interests. Range of software right willlegitimate reverse engineering and restrict it. Protection time of software will mutchup to business time of software. Registment will acquire software right. legislationwill reduce duties of final people.
