Nowadays, the right to educate is a subject People are concerned about both in abroad and in international areas. It regulated every people had the right to educate in many international documents. The realization of the right to educate has been regarded as a duty every country. In our country, the right to educate is a basic right of every citizen which is regulated in the constitutional law and other regulations. From the 1954 Constitutional Law to the present constitutional law, they all regulate that citizens have the rights to educate. Education is not only the preliminary terms of a country's richness and progress, but also is urgent issue of a country. Although in our country the right to educate is a basic right of every citizen which is regulated in the constitutional law and other related regulations, there are many cases of infringing upon the right to educate.This paper, absorbing fully domestic and international related theoretical research accomplishment, taking constitution and educational legal regulations as well as related cases as major source material, and adopting method of historical and positivism analysis, studies the legal remedy system for right to education and seeks to establish and perfect he legal remedy system for right to education. I hope it will offer for the educational legislation, law enforcement and administration of justice of our country the suggestion and opinion that can be referred to, and eventually will have significant theoretical and practical meaning for realizing and guaranteeing the citizens' constitutional right to educate.This essay includes three parts. The first part is mainly about the problems of the right to educate. It first talks about the historical evolution of right to educate; then analysis the concept of right to educate; the value and the system of right to educate. The second part discusses the historical evolution of right to educate in our country and the present situation, adopting the system of right to educate analysis existing problems and reasons on the right to educate of our citizens. The third part details the legal system guaranteeing the right to education. Based discussion on part one and part two, it presented the concrete system for protecting the right to educate in the way of legislative, administrative and judicial way.
