Achieving intergenerational justice is an important requirement for the sustained development,mankind must do their utmost to fully estimate the possible consequences of their own acts which is responsible to future generations of its own.The intergenerational justice theoretical requires to limit the present generation's behavior, which is in conflict with traditional social nature of conflict. As early as in ancient China,there is the concept of harmony between man and nature,but it is simple,and the realistic basis to achieve the necessary intergenerational justice is not exsit. Until the 20th century, status severe environmental problems caused the awakening of consciousness, western scholars began systematically introduced and expounded intergenerational justice theory, if the present generation's behavior has affected the quality of life of future generations, and future generations will be left is a broken earth,thus, the representative of the United States for some countries have started to carry out intergenerational justice legislation to regulate the legal system from the perspective of establishing the status of intergenerational justice, Also on the international protection of the interests of future generations of judicial practice.In China, the intergenerational justice in the status of environmental law is rather ambiguous which faces obstacles from traditional values, legal forms of expression and traditional legal thinking, In order to promote intergenerational justice to achieve ,the status of intergenerational justice can be established in China's Constitution and the environmental law, At the same time to improve intergenerational justice theory and identify specific operational standards.
