On Institution Of Subjects' Environmental Standards

The core vocabulary of contemporary China is "development" and "harmony".That is to say ,we must not only develop but also develop sustainably to leave space for the development of future generations.That need we make harmonious as a standard to deal with the relationship but human society and nature .To promote the relationship between man and nature harmoniously is not only become the ruling party's program,but also become the basic national policy. However,when we were going to implement that program and policy,we find that that many systems and measures which was deweloped under the the old concept of development has been unable to meet the requirements of Harmonious development concept. China's environmental problems is serious now. So constructing a kind of legal system of environmental management which could meet the requirements of harmonious development concept will play a positive role in constructing ecological civilization,harmonious society and the country under the rule of law.Population,Science and Technology,the way of economic development are three most important factors affecting the environment. And those three factors all exist in China and have their own characteristics. Population, science and technology ,the way of economic development working together make the environmental issues prone and difficult to resolve. As the main social system to resolve environmental problem,China's current environmental management system has serious weaknesses and shortcomings which unable to meet the needs of social development. Therefore, based on the idea of harmonious development between man and nature,it must establish a new pattern of rights and obligations between man and nature. And then we can create a new legal environment management system——"Institution of Subjects'environmentalstandards"in that model.By using Theory-Research Methods,Empirical research methods and Economical analysis method,the article analyzed the necessity and feasibility of the establishment of Institution of Subjects'Environmental Standards. Institution of Subjects'Environmental Standards is a Standards System that subjects possess and use natural resources. It including two main systems: subjects system and trading system of environmental resources right. Institution of Subjects'Environmental Standards. are systems which affected by many factors,for example,population,the total environmental resources, social values and technology,etc. So the establishment of Institution of Subjects'Environmental Standards should according to the actual local situations of that time.The establishment of Institution of Subjects'Environmental Standards will benifit for the development of environmental law,Safeguard of social justice and social equity.And it also has important significance to Socio-economic balance and sustainable development,the change of Social production methods,and the improvment of the people's welfare.
