The Research On The Crime Of Fraud Of Loan

At present, the behavior of the fraud of the loan frequently takes place ,which has seriously scathed the ownership to the fund of financial institution and wrecked the steady system of credit.Some problem have not been thoroughly solved about the determination to the crime of fraud of loan,and the actual law has emerged some limitation which need research on the crime of fraud of loan in detail.nowdays,as the financial systerm of the world has been lashed by the US Subprime Mortgage Crisis,the particularly research on the crime of fraud of loan could prevent and punish the crime of fraud of loan.This thesis adopts the normative and literature search method ,by investigating the regulation of the criminal law and integrating the production from scolars,which expounds the concept ,process of legislation and inscape of the crime of fraud of loan and also discusses the determination to the criminal purpose of possessing loan illegally and the solution to problem of the commom crime about the crime of fraud of loan.Finally,this thesis gives the suggestion to perfect the crime of fraud of loan to regulate it in criminal law comprehensively,also proposes the construction to the crime of deception of loan.
