From a global perspective, the crisis situation, or a state of emergency has become a part of the country life and international life in a common phenomenon, especially those of the third world countries , is full of all kinds of internal conflict and unrest, when the contradiction can not be resolved , a state of emergency will be implemented as a return to normal state. And national emergency power becomes an inevitable choice. However, the unrestricted right in the emergency state will also lead to the downfall of constitutional democracy. So, how to regulate the emergency power system, protect basic civil rights? The principle of proportionality is the most effective principles to control the emergency power, in the role of administrative law as "the principle of good faith" in the role of the Civil Code, both of which are available as in the corresponding legal departments "imperial terms."...
