A Study On The Constitutional Protection Of The Right To Life

The thesis is focused on the constitutional protection of the right to life. In the first section, the author summarizes the implication of the right to life after reviewing the development process of life and the right to life and contrasting with the appeared definition concerning the right to life. Then the thesis discussed four contents about the right to life: the right for the life development naturally,the right to maintain the life safely,the right to get help,the domination right of life, and creatively put forward the indirectly domination right of life. Last the thesis analyses six property of the right to life: Naturally and socially, morals and law, foundationally and equally.The second part of the thesis discusses the meaning and the bases of the constitutional protection of the right to life. The constitutional protection of the right to life not only need write the right to life in the constitution but also contains the basic principle of right-dominant and responsible government. It is a system which is guided by constitution and is constituted by the other department law; it is a promotion progress. The constitutional protection of the right to life has the theoretical and practical foundation.The third part of the thesis introduces the achievements of academic research,the production of legislation and the practical achievements about the constitutional protection of the right to life. And then this part analyses three constitution items——health to right,human rights and material help right. Finally this part points out theshortage on the constitutional protection of the right to life.The fourth part of the thesis puts forwards the point how to constitute the item of the right to life, after contrasting the item of the right to life of many countries constitution. This part uses the methods of the legal interpretation to solve the shortage that our constitution did not write the life or the right to life definitely. At last, this part puts some suggestions and measures to promote the constitutional protect of the right to life.
