Study On Contracted Riders

As society and economy developing and motor vehicles increasing, accidents has been continuously increasing and more and more contracted riders has been appeared. Many people are now still unfamiliar with contracted riders and its definition as well as its forming conditions.Its legal status of the parties and the allocation of liability for damage among contracted riders have not been regulated specifically in China's laws and regulations. That is not conducive to deal with such issues in the practice of the administration of justice. Based on the analysis of a typical case, this paper will show you a preliminary discussion on the formation of contracted riders in traffic accidents using the methods of linking theory with practice and comparing. Through this paper, you can see clearly the conditions of formation of contracted riders and their membership.Recognizing the conditions of formation of contracted riders and their membership, as well as the rights and obligations of the parties, then determining their accountabilities for damages in traffic accidents, this has vital significance for analyzing the complex legal relationship and dealing with specific cases in the judicial practice.In this paper, the content is divided into three parts: In the first part, I will make analysis specifically of what is contracted riders and what conditions they need ,as well as how to identify them and so on, make out how to recognize and distinguish contracted riders and their relationship and other issues, mainly using the method of linking theory with practice;In the second part, through analyzing how to conduct litigation in order to protect their own legitimate rights and interests, I will show you how to define their legal status in the litigation also using the method of linking theory with practice; In the third part, I will make analysis specifically how to provide in the law and how to define the legal responsibility in practice abroad. Also I will show you how to identify the legal responsibilities in China's "Law on Road Traffic Safety". In this part, I will tell you what and how to intensify the legal responsibilities of contracted riders, mainly using integrated comparison method.
