Research On Guarantee Of Human Rights In Civil Compulsory Execution

"Tough in execution"is a hard topic in China's civil action field which has blocked the realization of creditor's rights seriously. "Tough in execution"is ,to some degree, the impingement to people's basic rights. For this reason, the courts have taken a list of measurements to relieve this matter, however, just in surface. At the same time, "execution in disorder"has appeared in civil action, which makes the executor a tool to impinge on human rights. These two phenomena are converse to the whole process of legal civilization. To probe into the real source of these phenomena, the study to our execution and human rights is not concrete. As for civil compulsory execution which protect and realize people's private rights .whether is it the enemy or a guarantee of human rights is the goal of my thesis. The author believes that we should research from substantial rights and procedural rights in civil compulsory execution in order to promote the guarantee of creditors and the executed people's rights.
