Research On The System Of Police Testifying In Court

The evidence matter is a center of the criminal procedure, police testifying in court is a problem demanding prompt solution in practice and theory. It was admitted not in common law but in civil law that police is qualified as a witness, who can testify in court. Under the influence of china's traditional prosecution and justice concepts, and in view of the current situation, which are undeveloped evidence legislation, the pipelined suing mode in our current justice system and the separate procurator and police system, the institution of police testifying in court hasn't been established.This thesis was explored from the basic theory of police testifying in court ,on the basis of researching the problem in comparison with the common law and civil law, analyzed the obstacle factor that why we didn't build up the system police testifying in court.Furthermore, the author combined china's present legislation and justice situation, proposed that we should build up this system, and from the perspective of the range ,carrier and procedure of police testifying in court, the author put forward the feasibility of china's local police testifying in court to make up the limitations of the existed law.
