The system of criminal search is an important system in criminal proceeding.Its implement has very big mandatory and it directly takes property,person,right of privacy infringing upon the relative people,etc as price.Because of this,the modern law-ruled countries carry out construction on this legal system as a matter of principle that is called criminal due process.The system of criminal search has lots of problems and these problems in existence are burning in the field of legislation,or in the process of actual judicial practice.These problems have greatly hindered our country from building a course of socialism ruling society by law.The introduction of criminal due process has important practical and immediate significance to the transformation of the system of criminal search.Therefore,the main body of this thesis takes criminal procedure reasonable and legitimate as theory in order to carry out the reformation probing searching system in our country.System of criminal search can not only bring whose due function better,but also ensure citizens' legal rights sufficiently.The main body of this thesis is allotted for five parts.Partâ… ,introduce the theory of the system of criminal search.Partâ…¡,Summarize the legalization of the system of criminal search according to discoursing the theory of criminal due process.Partâ…¢, carry out the comparative methods to explore the system of criminal search in the developed country by law mainly.Partâ…£,take this as basis and find out the primal problem of the system of criminal search in our country.Partâ…¤,give some suggestions to the transformation of the system of criminal search according to the comparative methods.
