On Transporting In Criminal Law

Transporting is an important strategic industry, infrastruation and factor that influes the development of economy and society. In judicial practice, there are more and more crimes involving transporting. At the same time, the majority of crimes, of transporting still remains analysis in substantial crimes, but lack of overall and systemic research. In criminal law, crimes of transporting as a kind of crimes that are more serious and take up greater proportion than other crimes demonstrate much serious danger to our society, as a result, law designers serious punishment to there kind of crimes. But the reason of that the present theory is lack of analysising crimes of transporting makes the way of dealing with different types of crimes of transporting not show the principle of suiting punishment to crime and criminal. Responsibility leading to those consequences that crimes of transporting are absorbed by other crimes or are categorized into one crime through the theory of one crime,or making crimes escape from law punishments for the reason of according punishment machism. Abovementioned defects will became a danger to the development and stability of society. If those kind of crimes can't become a part of criminal law. Those crimes will constitute threats to the safety of people and nation benefit, furthermore, greater damage to our society. At the same time, more and more crimes will came into being, and it is paradox with criminal law-making purpose. A large number of judicial practices indicate that there's great necessity of crimes of transporting independent existence, but there're needs of make-ups and perfections. As a result, on the basis of the present content of our country criminal-law, author will came up with view's on the perfection of crimes of transporting through defining the concept of transporting, transporting function and criminal law significance and analysising other different actions, furthermore, probinginto fundamental theory of transporting in criminal law from the prospect of analysis of the criminal law.So,in order to improve the legislation of crime of transporting ,I introducing some views:Firstly, set the crime of unlawful transporting in existing criminal law; Secondly, add some crimes in which the act including "transpotting" in relative articles of law; Thirdly, perfect the legislation of administrative penalties for public security, fix the disadvantage of criminal law.
