Reform On Land Acquisition System And Protection Of Farmers' Rights And Interests

With continuous promotion of the urbanization process, the sustained, stable and rapid development of economy and population growth have made our land resources scarce, which seems extremely conspicuous nowadays. Collective land acquisition system and the protection of rights and interests of farmers concerned have become a hotpoint. In the initial stage of reform and development, there are still many flaws in our collective land acquisition system, which couldn't fully effective protect the farmers' rights and interests. For example, the real estate ownership is virtual and fuzzy which leaves farmers' rights on land possession and disposition unprotected; without a clear purpose of land acquisition, some local governments wantonly expand the scope of land acquisition; farmers can not really enjoy the rights to participate in and supervise the process because of unreasonable land acquisition procedures; inadequate compensation of land acquisition and unsatisfied resettlement of farmers. All these above directly threaten the survival rights of farmers. According to the practical condition of our country and referring the relatively mature land acquisition system of developed countries and regions, the article holds the point that: to protect farmers' rights and interests, we should perfect the land acquisition system in the following aspects: 1,Define and check up "the public interests" strictly; 2,Establish the system of land ownership gradually; 3,Improve the land acquisition procedure continuously; 4,Determinate the scope and standards of the land acquisition compensation reasonably to explore multiple means of resettlement compensation, and improve the mechanisms of compensation distribution and dispute settlement.
