On The Regulation System Over The Market Access Of Foreign Banks

To establish effective legal system for market access of foreign banks in the conditions of financial globalization and liberalization is important for the prevention of financial risks and promoting the healthy development of the domestic banking sector, and is also a major problem for the countries of the world to face. According to China' s WTO accession commitments, by 2006, China had fully open the domestic banking market, and foreign banks enjoy equal treatment to enter the Chinese market with Chinese-funded banks in geographical customer services, the foreign currency business, they would not be taken restrictive measures violating our WTO commitments. This thesis through the analysis of the basic system of market access for foreign banks, the relevant international legal rules established by the framework of the GATS and the Basel system of transnational banking supervision and China' s market access for foreign banks in the laws and regulations , points out the more significant errors and problems existing in the legal system of our market access of foreign banks, and gives some advice to improve. This thesis consists of four parts. This part also describes the related legislative principles for the legal enactment of market access of foreign banks and the aim and necessity of regulating market access of foreign banks.Partâ…¡: Through the analysis of the specified information about the forms conditions and scopes of market access of foreign banks in some countries, this part provides a frame of reference for our legal system of market access of foreign banks.Partâ…¢: This part analyses the relevant international legal rules established by the framework of the GATS and promulgated by the Basel Committee on market access for foreign banks, and provides the legal basis for the construction of legal system of market access of foreign bank in our country.Partâ…£: The last part of this thesis introduces the history and status of legislation of our country' s market access for foreign banks, and notes the problems related to China' s system of market access for foreign banks, the final opinion is also raised that it should be improved in legal system, specific rules, regulatory systems and regulatory measures.
