The International Protection Of Utility Models And Its Reference Point For Utility Model System In China

At present, the comprehensive competition among countries in the world is the competition in the economic and scientific and technology fields to a great extent. Utility models system, as a subject of Intellectual Property, although originated from the developed western countries, is more important to developing countries at present stage since it fits the scientific and technological and economic situation of developing countries more.At first, the dissertation gives a general introduction about the utility models system through analyzing its origination and present situation. Then, it emphasizes on international protection of the utility models and states the different levels of relieves in legislative, administrative and judicial aspects. It introduces and compares the legislative, administrative and judicial relieves in international organizations and developed countries. At the same time, it explains the useful reference to the development of the utility models system in our country from macro-aspect. Finally, it makes several suggestions about how to implement the international protection strategy of utility models for enterprises from micro-aspect.
