Grain is the basic need for people living on this planet. Therefore we can say that all the civilizations start with grain. However, the fact is that not every country can self-support by its own grain production, sometimes, this even cause grain crisis. Consequently, the problem of grain security and grain trade come into existence.As the major countries of grain production in Asia, China and Kazakhstan share nature common characters and complementary elements in grain-product field. But because of the lack of sufficient cooperation in grain trade, the two countries have only a small quantity of grain trade. This makes the cooperation in grain trade between the two countries become possible. Therefore, how to provide international legal supports to the grain trade between the two countries in the frame of Shanghai Cooperation Organization becomes the gist of this paper.And common grain security requires free grain trade, so this paper, employing the methods of surveys, contrast analysis and data analysis, makes a comparative study of the status of grain production and trading in Kazakhstan and China. Besides, it also uses the relevant experience of other free-trade regions for reference to show the possibility of constructing Sino-Asia food security institutions in the legal frame of Shanghai Cooperation Organization and resolve the food security problems faced by all the countries in this region. In that case, the improvement of the legal system in each country can be achieved.
