The Research Of Endowment Security Trust System In China

Any of the new system's formation, development, until the final maturity needs a strong economic base and social support, suitable for a country's situation and meet people's community needs is the fundamental driving force to explore new system. This paper discusses the Endowment Security Trust system, which bases on a specific national condition, named the ageing of the population and the unique advantages and value of the trust. After an objective analysis of China's ageing trend and the problems of current endowment security system, first proves that it's reality to use the endowment security trust system. In this context, the ageing of the population issue is not only a problem of the elderly individuals, but also social problems related to the social stability and harmony, while the Trust is a highly flexible property management system, which in foreign countries has been widely applied in civil, commercial, social welfare and other fields, the Trust plays very important roles both in the asset management and many other social functions. So if the trust system can innovate a new trust product to provide a way to solve our endowment security's problems is the issue this paper wants to research. Found through research, either from the elderly themselves, or from social problems exist in reality, with the trust's features, trust reflects it's applying value in an ageing society.On this basis, the author designs the endowment security trust system. The paper describes the basic principles of endowment security trust, including it's meaning,characteristics,comparison with other property management related to the aged,similar trust products in foreign and the initial classification Design. The article is focused on the analysis of the legal relationship of endowment security trust. The author believes that the core of endowment security trust is how to protect the rights of the aged, as the parties of endowment security trust, so raised the "one core, two elements" normative focus, that is fully protect the rights of the aged, as a client or beneficiary,trustee fulfills obligations cautiously and faithfully within their areas of responsibility and establishes trust supervisors. Another, The author also put forward some suggestions for it's operation support system.In this paper, using a combination of the theoretical and practical methods, the last part of the article comments the endowment security trust model exist in the real life. Because there are now almost no relevant trust varieties in the city, but there is the land trust in rural, with the protection of nature. With the particularity of rural elderly population, So mainly focused on rural, comments the characteristics and operating model of rural endowment land trust compared with other endowment security trust products.
