A Comparative Study On Criminal Protection Of Intellectual Property In China And Korea

Since Korea and China have established diplomatic relations in 1992, economic exchanges have continuously expanded. Recently, both countries have become one of the most important trading and economic partners to each other.Nevertheless, due to the lack of understanding of each other's laws, there are constant disputes, and research efforts about the laws on intellectual property have been minimal as well. Under these circumstances, this research has been done for the better understanding of China and Korea each other.First, the necessity of this research has been claimed in accordance with the rapid increase in exchanges between China and Korea.Second, history of two country criminal protection of the intellectual property and the comparison of both countries on current status of crimes on intellectual property has been presented.Third, intellectual property protection clauses in Chinese and Korean penal code have been translated and explained. And the relative legal clauses from trademarks law, patent law, copy right act, prevention of illegal competition and protection of business secret law have been presented, and the differences of each countries clauses have been discussed. Finally, the areas of improvement of each country clauses based on the comparison have been identified. And, the necessity to study about advanced law system has been suggested.
