Construction Of Dispute Settlement Mechanism Of Chinese Free Trade Area

With regional trade developing quickly, regional trade dispute settlement mechanisms also become an important subject in the field of the International Economic Law .Based on the special position"one country two systems"in WTO and the fact that there is the same ancestor among the two sides and four regions and the actual demand of complementary trade , building Chinese Free Trade Area has become a strategy goal of the regional economic integration in China. A dispute settlement mechanism plays an important role in the legal framework of the Chinese free trade area. The study of the article can improve the legal framework, and make the economic disputes among the two sides and four regions solved better.Beginning the regional trade dispute, the author express its concept and characters, and point out that peaceful settlement is the main method to solve regional trade disputes nowadays. In order to construct the dispute settlement mechanism of Chinese Free Trade Area, the author introduces several relatively mature dispute settlement mechanisms of the free trade areas in the world, including North America Free Trade Area,European Union , the Asia Pacific Economic Co-operation Forum and Association of Southeast Asian Nations, and immediately introduces the dispute settlement mechanism of WTO. The author also analyzes the advantages and disadvantages of these dispute settlement mechanisms.After analyzing the causing reasons and characters of economic disputes in Chinese Free Trade Area, the author point out the fact that economic disputes in Chinese Free Trade Area cannot be solved depending on the legal cooperative systems among the two sides and four regions, and that it's not proper to deal with economic disputes in Chinese Free Trade Area in WTO because of protecting the legal rights of Chinese people. Consequently, Chinese Free Trade Area should build its own dispute settlement mechanism.Finally, I focus on how to construct the dispute settlement mechanism of Chinese Free Trade Area. This is the essence and creation of the article. Through analyzing the characters of the dispute settlement mechanism of Chinese Free Trade Area, the author find it similar to that of North America Free Trade Area in some aspects. Although the author disagree to deal with economic disputes in Chinese Free Trade Area in WTO, dispute settlement mechanism among the two sides and four regions can refer to the advantages of the dispute settlement mechanism of WTO. Therefore, based on dispute settlement mechanisms of North America Free Trade Area and WTO, connecting the special circumstances in the area, the author elaborates the conceit about dispute settlement mechanism of Chinese Free Trade Area.
