Research On The System Of People's Jurors Under The Obligatory Value

The jury system is a kind of litigation system that national judgment organization absorb nonprofessional judge to participate judgment and to make arbitration and law evaluation. Nowadays the litigation law of the international community all widespreadly confirm jury system(or call verdict system) as a kind of basic judgment organization system which has played a very important role nowadays in the judicatory of all countries .However, the people's jury system which is the outcome of the China-turn of the west jury system, relieve much antinomy in the theories and practice in operation and has many problems, it face the embarrassed ground of the sort such as chicken rib , whether it should be owned or given up is hard to choose .Analyzing blemish of the legal theory of the system of people juror in our country, this thesis think that the corpus position of the people juror is not clear, and the law responsibility isn't explicit, which is the reason that leads to its inability of burdening the important responsibility exercising judicature, solving dispute, guaranteeing fair justice and promoting the legal system social development etc. Then the theses carry on a law thinking to people's jury system and elaborates the existent necessity and importance of system of people juror in our country in response to its obituary value. Finally it try to put forward a set of effectively basic way of thinking that perfect the people's juror's system of our country from the constitution law, organization of the court and judge's law.
