Research On The Social Security Of The Landless Peasants

Constitution of the People's Republic of China stipulates: "The State respects and safeguards human rights" and "The state shall establish and improve the social security system on the level of economic development." Based on the above constitutional provisions, the establishment of social security system for landless peasants is an important measure to respect and protect the human rights of landless peasants, as well as implement the spirit of constitution.It is very meaningful issues that we can study the social security of landless peasants by using the rights of Landless peasants as subject matter. In my paper, the formations of the landless peasants were discussed. The main reason which forms landless peasants is the country's land expropriation. Then, landless peasants is defined by author as: a class of legal subjects who corresponding loss the usufruct, the right of employment, the basic living security, the right to social security and other rights related to because of losing land. By reason of losing land, these peasants exist many difficulties in the basic living, employment, medical treatment, provide for the aged, and so on. These peasants urgently called for the establishment of the necessary social security system to protect their rights.The social security of landless peasants has been exploring. Firstly, we must take Economic strength, democratic management, legal protection, effective supervision as conditions. We can establish the social security system for landless peasants by the statutory rights of landless peasants into reality right to achieve the social security of landless peasants. Landless peasants eventually establish a social security system.
