Study On The Administrative Commitment

Along with the further development of China's reform and openness, the communications between China and other nations in the political, economic, and cultural fields, China has accelerated its pace of globalization. The rapid development of market economy and Chinese people's awareness of law have prompted the governments to promote and practice the concept of serving the people in the administrative institutions and among their staffs. A wave of new public administrative reform pushed by the British government has quickly spread to governments of other countries. In this reform, one concept,"Reforming government with enterprise spirit,"having borrowed from corporations on how to serve their customers, has been evolved into a new administrative means and model called"administrative commitment". In China, starting from the Construction Commission of Yatai Municipality Government that learned the experiences of British governmental reform in 1994, pioneered with a system of social service promise, this new model of administrative commitment has gradually spread all over the country.Theoretically speaking, as a product of the concept of a service-oriented government, the administrative commitment is a result of administrative means, the same as administrative contract and administrative guidance. As a creative method in the government service, administrative commitment has changed the rather rigid management models of the administration and has played an important role in the construction of socialist harmonious society. However, this new method has not been the focus of administrative law research and there is still a lack of consensus to guide and support the administrative commitment practice.This paper has discussed the meaning of administrative commitment on a comparative basis, distinguished it from some other well-defined concepts on administrative behavior, in the hope that the study of administrative commitment will be one of the subjects of administrative law studies. It has analyzed the historical background and current status of administrative commitment, with case studies on the how to check and supervise administrative commitment and how to solve administrative commitment disputes through administrative and judicial means. Finally, it calls for the academics to put more effort on the study of administrative commitment.
