Study On Environment ADR Mechanism Of Our Country

Along with economic development,environmental problem is gradually protruding to show , environment dispute also grow gradually, which have brought challenge to traditional dispute solution. ,every countries begin to reform the claiming system to need of environment dispute , and develop the various ADR to solve environmental dispute. Our country has similar problem also, when perfecting for original lawsuit system ,begin to emphasize slowly the ADR that plays the part role of for environmental dispute solution.But because original environment dispute claiming system have lots of problem,which make ADR can not coordinate with it. In view of above, this paper discusses for environmental ADR mechanism. The paper make focus to environmental dispute, basic theory of environmental ADR and characteristic of ADR , show the existent problem of our country in the aspect of environmental ADR through advanced experience and the related system for America, South Korean, the Japanese Taiwanese area of our country and other countries, then make the perfection suggestion of this system of our country.This paper divides into 5 major parts .the first part is foreword introduces meaning and the purpose of selection of subject Second part is general for environmental dispute,introduces legal property, feature, type as well as the concept of environmental dispute mainly. The part of 3th is the basically theoretical of ADR and ADR mechanism . 4th part analyse the present situation of domestic and international environmental ADR system and finds out the defection of our country in this respect. The part of 5th is the thought of author for the perfect environmental ADR mechanism of our country by above analysis.
