Geographical indication, like trademark, is an independent type of intellectual property. What is the best mode to protect geographical indication, is very important when researching and lawmaking art taken on this subject. Firstly, via differantiating and analysing geographical indication and the relative concepts, legal charateristic, the attribute of geographical indicatiion right, and the relation and difference between geographical indication and trademark, this text takes further research on the legal attribute of geographical indication. Secondly ,before introducing different protecting mode of geographical indication and analysing the merit and defect of it , this text analyse the academic reasons of protecting it. Finally, by analysing the present legislative and administrative state, this text finds the problem existing in the double legal protecting mode of geographical indication and adminitrative system, and give suggestion on perfecting the system of geographical indication protecting from the following aspects: regulating and consolidating the words about geographical indication, dealing the relation between geographical indication properly, and establishing special law on geographical indication.
