The Confirmation Of Joint Tort And Liability Of Copyright

With the development of the division of social labor and the technologies of broadcasting, the broadcast of works has occurred as more detailed divisions and links, which leads to more and more complicated infringements of copyright. Because the complicity of tort decides the complicity of joint tort, there are different ideas and treatments in the confirmation of joint tort and liabilities in each local court. Even the researchers in academia have various opinions on this issue. In this article, the author has proposed a feasible plan to confirm the joint tort and liability of copyright with many judicial practices, which include the views of the cause of this activity, the subjective analysis of defendants on the meaning of faults, the methods to confirm the joint tort as well as the ways of liability. Moreover, this plan has followed the principle to fully protect the benefits of the holder of the intellectual property rights as well as avoid exaggerating the liability of tort-feasors.
