Research On The Arrangement Of Relatively Concentrated Power Of Administrative Penalty

The relatively concentrated power of administrative penalty was created by the LAW OF THE PEOPLE'S REPUBLIC OF CHINA ON ADMINISTRATIVE PENALTY enacted in 1996,with the aim to solve the problems of repeated punishments,low efficiency and undue disturbance during imposition of penalty. Since the experimental implementation of this arrangement from 1997,it has been widely accepted by various governments, departments and the grass roots. This arrangement has had a good impact on the reform of governmental administration and establishment of more scientific system of administrative imposition. However,as a kind of systematic creation arising out of practice,there appears a series of problems during the implementation of this arrangement because of short lapse of time and hardly no experience to learn from. It is true that no arrangement is perfect. In this thesis,the author firstly analyses the conception,characteristics,essence and value of the arrangement of relatively concentrated power of administrative penalty,secondly puts forward questions arised during implementation,finally provides suggestions on relevant legislation to improve this arrangement.
