With the development of the society, Merchandising is working up gradually, under the situation of richer commodity today, the Right should be protected and supported for everything does not disobey the society good vulgar and commodity related in together and things or the phenomenon which can produce the increment (including personality essential factor and non-personality essential factor), but the law actually does not have to carry on the suitable protection and the respect promptly correspondingly to this kind of phenomenon. I myself herein try to carry on the ponder using the civil law basic principle to the Merchandising phenomenon, although many scholars thought that synthesis method may be used to carry on the protection to the Merchandising phenomenon, but it is impossible to carry on the full protection to the Merchandising if we can not confirm that the Merchandising is basic right for the people according to the legal principle theory of law, it is the same with the real right we have for the solid right, Since it is a set of complex and difficult process to make the rules and regulations of the civil law system, if we think a lot of integrity of the system or the theory long-term development or have a deep discussion on the rules and regulations of Merchandising protection and then Merchandising right protection is too far from us or might not be done.What I can do is only to have a simple discussion on the Merchandising right production foundation and the content, as well as same or similar confusion aspect from the Merchandising right carrier with other intellectual property rights, or the related right object to carry on the discussion to the Merchandising right, thus to realize that the essence of the Merchandising right is a kind of right which uses the impression or the prestige to produce the increment. Look forward to the participation of the colleagues who are ambitious to the research of Merchandising right, promoting the regulations of the commercialized power phenomenon reasonably and scientifically, protecting the Merchandising right better.
