Research On The Relating Issues On The Corporation Crime Against Environment

This article firstly analyzes the definition, characteristics and types of Corporation Environmental Crime, and then makes a comparison between China and foreign countries on the legislation of Corporation Environmental Crime. After that, the article describes the structure characteristics of Corporation Environmental Crime from four sides: the Object, Objective side, Subject and Subjective side. At last, the article gives some legislation advice on the improvement of Corporation Environmental Crime in China in five aspects: First, adding the law on Potential damage offence of Environmental Crime; Second, introducing the No-fault liability properly; Third, enlarging the use of property penalty; Fourth, adding the type of penalty for the Corporation Crime; Fifth, enhancing the use of non-criminal penalty measures.
