On The Regulation Of Resale Price Maintenance In Antimonopoly Law

As one of the vertical restraint condeucts,the behavior of Resale Price Maintenance(RPM) often displays as a kind of fixing price behaviors.And the compelling power and collusion promote it's development.Although the RPM has it's rationality,it also has the serious malpractices of anti-competition.In this situation,the RPM will deprive the right of deciding price of related business.It will also damage the rule of competition and the interest of consumers.The negative influence of RPM have imposed pressure and menace on our market's sound competition-order.But concerning the RPM,there are some coarse places in the Chinese Antimonopoly Law,and we should replenish it as soon as quickly.Because of this,the author maintains that the paper has it's theoretical and practical significance.Besides the preface and conclusion,this article is consisted of four chapters.In the first chapter,the author gives the definition of RPM,and analyzes the sorts of RPM.After giving the definition of RPM,the author compares the RPM with other similar behaviors or phenomenons.Then,the paper puts forward two different classifies about RPM.In the second chapter,the author analyze the necessity of the antimonopoly legislation for RPM.From the angle of fair and free competition,economic efficiency and interest of consumers,the author give some reasons for the regulation of antimonopoly legislation.Beside that,the author also analyze and summarize the superiority of antimonopoly legislation'means.Chapter three concludes the regulation models and the legal duties. The author expounds emphatically on the regulation rules and legal duties in orther countries' experiences.The paper also inquire the related facors of exemption for RPM.Based on the above analysis,chapter four emphatically focuses on the conclusion of RPM in our country's Antimonopoly Law.After the flaw analysis on our Antimonopoly Law,the author gives some advises to perfect our nation's Antimonopoly Law.At the end of this paper,the author gives the main conclusions of this article.
