On Judicial Review Intensity Of Administrative Discretion Power Of Police

The administrative discretion power of police arises from complicated and comprehensive social conditions. The police can disposes affairs more flexible and efficient by administrative discretion power. On the other hand, the misuse of administrative discretion power can result in negative result. Accordingly, the government should strengthen the legal review on administrative discretion power of police, which has been accepted and become a tendency for many countries nowadays.This dissertation focus on the judicial review intensity of administrative discretion power of police and can be divided into four parts. The article introduces the basic theories of administrative discretion power of police and judicial review intensity, and discusses the difference of judicial review intensity between mainland law system and British law system. The author reviews the system of administrative discretion power of police practices in China, and gives many suggestive measures on it.
