On The Concept Of Operator In The Perspective Of The Economic Law

Operator is an important concept in Economic Law. However, the connotation and denotation of the operator has not conclusive.The most common formulation of the operator is that for profit business engaged in the production, sale and service of commercial legal persons, other organizations and individuals. This concept make too much emphasis on the profit-making operators, however, ignores the operator as the main subject of the economic law to be borne.In particular, the definition of the operators in civil law as "legal persons, other organizations and individuals" can not be highlighted as the main characteristics of economic law. This paper attempts to study in the perspective of economic law, to analysis and define the operators, in order to resolve the existing problems, improve the subject theories of economic law and guidance judicial practice.This paper is composed of three parts including the foreword, the body and the conclusion.The foreword gives a brief introduction of the thesis'topic background in the first place. Thereafter it sums up and analyzes the review of the study on the relative issues of our current research, and evaluates the review as well. Finally, this part introduces briefly the content, the thought of demonstration and the innovation.There are four parts in the body.The first part, introduces the research of the operator and the existing problems. Through the part of the discussion, you can clear the reasons for the selection and significance of the study.The second Part deals with the theory of the law subject in civil law, commercial law and economic law. The study is the theoretical support of our study.The third part is the concept of the operator. On the basis of the two parts above, through analysis, comparison of the current operators of the existing definition, pointing out that the current lack of defined operator, and then define the concept of the operator.The fourth part is about the extension of the operator defined. That part is on the basis of the definition of the meaning of the operator in the third part.The conclusion part highlights the significance and accomplishment of the thesis.
