Real estate brokerage is an important aspect of the real estate industry. With the development of China's real estate, the importance of real estate brokerage is becoming increasingly prominent and it has become an important topic on how to regulate it. China's regulation of real estate brokerage legal system is being set up, but there are still many questions. The purpose of this article is to research China's real estate brokerage legal system and put forward reasonable proposals.The first chapter is about the theory of the real estate brokerage, such as the concepts and forms of brokerage and real estate brokerage. On the basis of analyzing the limitation of real estate brokerage, the need of regulation is mainly discussed. In addition, the connotations of other countries and regions'real estate brokerage are briefly introduced.The second chapter is the research about the theory of real estate brokerage, including the connotation, the basis of regulation. This chapter also discusses the system and principle of regulation.Chapter III and IV research the qualification and behavior regulation of real estate brokerage. The qualification regulation legal system can be divided into agency and broker regulation, including the access,exit of market and the management of qualification. The behavior regulation legal system is about the conduct and risk regulation. The conduct regulation includes the disclosure and information system, the transaction fund and commission regulation. The risk regulation contains the deposit system and the professional liability insurance system. The demerits of China's real estate brokerage regulation are also discussed in these chapters. The fifth chapter puts forward the proposals of consummating China's real estate brokerage regulation legal system. First, the regulation mechanism should be reformed through distributing the authorities of the government rationally and exerting the function of associations. Furthermore, this article proposes that we should improve the legal criterions, the qualification and behavior regulation system of real estate brokerage.
