Analysis Of Mode Of Administration Examination And Approval System Reform In Jilin Province

The system of administrative examination and approval is an important manner of the national administrative department to carry through administrative activities. It is, at the same time, a momentous means to supervise social and economic affairs beforehand according to the laws. What's more, it is a administrative behavior of the government to distribute and control resources. Since the reform and opening up, the system of administrative examination of our country has witnessed many rounds of reform, among which the reform occurred at the end of last century has called attention of different social circles, because of its background of basic foundation of market in our country, entering WTO to join in the global economy, building service-oriented government, implementation of Administrative Licensing Law. As a local governments government leading reform, the reform of the system of administrative examination and approval will inevitably develop step by step from voluntary, exploring patterns to the standardizing mode. This article attempts to base on the reform of administrative examination and approval system in Jilin Province to inductively analyze our current model of the reform of administrative examination and approval. On the one hand, it may help the Government of Jilin Province to lay a solid foundation for further, to search for fine ways, to create more actual effect and to promote the reform of administrative examination and approval system of the depth; on the other hand, it may provide references with our governments at all levels of reform to carry on administrative examination and approval system reform. This thesis discusses these topics from four aspects:First, collective dissertation of the reform of administrative examination and approval system from the three aspects: definition boundary, theoretical analysis and content summary.Administrative examination and approval is a concept, which is widely used but lack of clear definition. It is closely related with the concepts of administrative licensing, examination and approval of administrative licensing and non-administrative licensing approval and there is the difference between each other. According to"Administrative Licensing Law","several problems necessary to grasp about implementing the five principles of the reform of administrative examination and approval system"and the reality of our situation of the administrative examination and approval, licensing administration and the administrative examination and approval are the same at the connotation. Both of the two concepts are referring to the administrative act of an application by the relative person and approval of the administrative examination and approval departments. But they have different extensions, the scope of administrative examination and approval covers the scope of administrative licensing. This is mainly reflected in that the administrative examination and approval project is divided into two types of projects: administrative licensing approval projects and non-administrative licensing approval projects. Basing on the theoretical basis to define the concepts, the study on administrative examination and approval system reform should, at first grasp this feature of the same connotation, secondly borrow the spirit of the legislation of"the Administrative Licensing Law", thirdly strictly judge whether or not a project belongs to the scope of examination and approval of administrative licensing in the aspect of the application of the law.Administrative examination and approval is a commonly used politic way by all countries of the world nowadays. Among the four functions defined by our building service-oriented government of economic regulation, market supervision, social management and public service, in addition to market regulation, the other three functions are closely linked with the administrative examination and approval. In theory, foundation and limitations of the right of administrative examination and approval take the market failure theory, the theory of government failure as support basic. As an important form of government intervention, the administrative examination and approval is really necessary to make up for market failures. At the same time, because of the existing problems of examination and approval system as too many projects, too complicated process and lack of supervision, administrative examination and approval, to a certain degree becomes the main form of expression of the government failure. Therefore, it has become the goal of reform of the administrative examination and approval system to bring it into line with the needs of society, to be able to make up for market control, but not to cause government failure and to really serve the public as a means of promoting the public interest.Combining relevant legal, policy and practical operation of the administrative examination and approval, the reform of administrative examination and approval system studied in this thesis takes administrative examination and approval as the core of the object -the basis of the administrative examination and approval projects. This thesis studies the administrative examination and approval system reform from three aspects of the establishment, the implementation and supervision of the administrative examination and approval projects.Second, review of the reform of administrative examination and approval system in Jilin Province in recent years. As the old industrial bases in Northeast China and economically underdeveloped regions, Jilin Province whose economic development has achieved a certain degree of development still lags behind the national average at the overall level, especially in the opening, setting up a unified market system. In order to promote socio-economic development of Jilin Province, the reform of administrative examination and approval system reform has been taken as a breakthrough of the government reform and an important measure to improve the soft environment. The reform sets the cores of reducing projects, process reengineering and the contents opening. It takes the Chief Hall as a carrier to implement focus examination and approval, online examination and approval and electronic monitoring and supervision on the project implementation process; it is a examination and approval system reform at the core of the"the relative concentration of the right of administrative examination and approval of reform". The reform has made some success in improving efficiency, amending the public experience and bounding the approval authority. Compared to the approval of the domestic mainstream model, it has some advantages and disadvantages.Third, problems existing in the model reform of administrative examination and approval system in Jilin Province. The reform of Jilin Province's administrative examination and approval system was effective, while at the same time it has some defects such as unclear goal, unclear institution-building goal and lack of accountability system, because of its spontaneous and short-term effects.Fourth, suggestions to improve the model reform of the Jilin Province administrative examination and approval system. In order to further promote the reform of administrative examination and approval system, we need to go beyond the reality of the policy from the perspective of the need to consider the objectives of the reform of administrative examination and approval. It is required to recognize that the actions of approval from the administration of the government are the essence of government intervention the market. The examination and approval of administrative licensing belongs to"the law generally prohibited under the premise of the special authorization", while non- administrative licensing belongs to macroeconomic regulation and control, resource allocation, industrial distribution. To orient individually can ensure that the establishment of administration permitted projects in order to protect the public interest-oriented. The establishment of non-administrative licensing items should be adhering to the principles of "priority market", "self-first", "after the mechanism of priority". Under this premise, it can play the role of macro-control to avoid the market interfering with the distributing of the foundational resources and hindering economic efficiency improvement; Setting up a scientific project of the administrative examination and approval, the abolition system is to keep the administrative examination and approval system and socio-economic development in high harmony.This thesis holds that the reform of government institutions should base on the definitude of the aim of the reform of administrative examination and approval system to support the implementation of this goal. And then it should be further complemented by the concept of shape-related administration to build a goal-oriented, clear and efficient mode of administration examination and approval system reform supported by institutions and guaranteed by scientific supervision.
