Retention Of Title Applied In Contracts For International Sale Of Goods

With the development of global economy integration,retention of title has been widely applied in contracts for international sale of goods. However, different countries (areas) have different laws on retention of title, and there isn't any uniform international law concerning this issue till now. China also established the regulation of retention of title in its Contract Law, but it is still very simple and is hard to be applied to the complex dissensions of contracts for international sale of goods.This thesis starts with the current status of retention of title. The first chapter introduces the definitions, legal principles,and application of retention of title in different countries (areas). The second chapter analyzes the conflicts and harmonization of retention of title in contracts for international sale of goods based on case studies. The third chapter presents different kinds of legislation mode on law application rules of retention of title in international trade. Conclusively, the author presents some suggestions for establishing uniform substantive rules and conflict rules on retention of title in order to bring positive effects to the even more complex dissensions for international sale of goods.
