The Study On Public Surveillance

Public surveillance is the unique creation as a kind of imprisonment penalty in China. One characteristic of penalty development tendencies is from closed to open style in countries all over the world. Public surveillance is an open punishment method with Chinese characteristics which is in accord with global penalty development trends. As for the public surveillance, China's many criminal law scholars have researched it from different aspects. This article aims to analyze the public surveillance in China from five aspects, discuss advantages and disadvantages and how to improve this penalty in order to extract the following context.This article first gives a comprehensive introduction to the history, definition and characteristics of public surveillance and then on this basis, the article further conduct empirical analysis of public surveillance and make value judgments on the penalty from three perspectives targeting at the disputes on retention or abolition and finally after explaining the connections and differences of related probation system, community service sentence abroad and domestic community correction system, the article discusses the innovation and improvement of the public surveillance from legislative, trial and executive levels.
