Study On The Inscape, Cognizance And Legislation Perfecting Of The Crime Of Bribery

According to article 385, article 386, section 3 of article 163, section 2 of article 184 of the Criminal Law issued in 1997, the crime of bribery means the behavior of the state functionary who claims lawless gifts and money from the briber or makes benefits for the briber after receiving lawless gifts and money. But due to the complexity and particularity of the crime of bribery, there is plenty of contention on distinguishing the crime of bribery from non-guiltiness or from other crimes. In result, a lot of law cases cannot be judged in time, and justice and efficiency of the judicatory are disturbed.The thesis emphasizes on the study of the inscape of the crime of bribery, and also makes researches on the judicatory cognizance and criminal responsibilities, then puts forward some legislation perfecting opinions. The writer of the thesis hopes it can do good to the punishment and prevention of the crime of bribery.
