| The criminal legal aid is a kind of law system that the government provides legal aid to the people with economic difficulty or clients being suitable to the legal conditions for free according to the law; whose basic purpose is to achieve the law principle of "equality of everyone before law".With the continuous development of law system in China, great achievement of Chinese Criminal Legal Aid has been accomplished. The Judicial Ministry has proposed the blueprint of establishing legal aid system at the beginning of 1994. In 1996, the modification of Criminal Procedure Law and Lawyer's Law has afforded perfect law foundation to the gradual development of Criminal Legal Aid. The development of Criminal Legal Aid has gone through more than 10 years, but because of the lately establishment, there are many weaknesses both in legislation and law practice, and the development of Criminal Legal Aid is still far from the best point. This paper will analyze the present weaknesses of Chinese Criminal Legal Aid, and through the comparative analysis to western country's legal aid system combining the practice of legal aid in every place of our country, the article proposes some ideas to improve our country's criminal legal aid system.
