Research Of AIDS Patients' Human Rights Safeguard Mechanism

AIDS has spread all over the world since 1980s.In the process of fighting with it,we have reached the consensus that no matter what kind of politics ,economics,cultural systems,ervey country is engaged to protect the human rights and freedom of AIDS patients.This coincide with our national consititution and international responsibilitity. However, through the practice in over twenty years, we came to know that the discrimination or the desertedness of AIDS patients only leads to the worse result, instead of solving the problem. On the contrary, I suggest it be wise of us human beings to protect those AIDS patients. For my part, it seems that law plays an increasingly role in the struggling against AIDS. Although our legislation has many problems,adopt foreign legislation and advanced experiences and improving the constitution and related legislation is the best way to deal with AIDS.This paper consisting of four chapters,analyze the human rights environment of AIDS patients and legislation.The first chapter, aims to present the human rights which the AIDS patients enjoy and analyse the theory of human rights.Surviving is the most important right of human beings,so it is one of the legislative intentions;the right of equity and freedom of AIDS patients is damaged ,so one of the legislative intentions is to pursuit equity;also,it is the duty of all societies to help AIDS patients,it's the third intention;the last one is common safety intentions.The second chapter is mainly about the difficulties AIDS patients are facing of .The third chapter introduces the AIDS legislation and experiences of foreign countries,such as USA and British.The features of these are:its aims to protect individual's human rights;medical help is the first importance and being followed phycological help;community has more effect on helping AIDS patients. At the end of the thesis, concerned with present legislation problems of AIDS in China,and make a proposal of the legislation in the future, which should be based on the value of respecting, protecting and realizing AIDS patients'rights.
