A Research On The Victimity Of A Criminal

Generally, the research on the criminal is always as criminal himself being the main body of a crime in academia world. However, this thesis focused on the issue of criminals'victimization rather than on criminals themselves. Until now, the study of the criminals'victimization has not yet been systematically done, except few results occurred in the Criminology, the Criminal Law as well as Criminal Litigation Law. To arouse people's stress on the criminals'victimization issue, a comprehensive study on the process of how criminals are victimized is implemented and initiated in this thesis.The study method of criminal integration is used in this paper. It is divided into three parts to discuss the issue of the criminals'victimization besides this paper's introduction and conclusion. In the first section, the definition of criminals'victimization is put forward. To some extent, it is a dynamic process which is divided into three periods: firstly, before acting crimes. The criminal may be the scapegoat of the society, Nation or others in the influence of various factors; secondly, after acting crime, the criminal is mistreated by the Legislation or Judiciary; thirdly, the criminal gets injustice treatment after sentence or the unfair treatment after returning the society. On the basis of data study, in the second section, the paper systematically illustrated what is in the form of beforehand, in the course of and after criminals'victimization. This demonstration will enable people to have clear and whole grasp of the issue. In the last part, the paper has listed some measures to solve the problem of criminals'victimization, proposed that not only the force of politics, economy, education and culture other than the basic Legislation, Judiciary is required, but also the Legislation, Judiciary, criminals'treatment as well as re-socialization is required to be improved. By implementing the prevention measures in the process of beforehand, in the course of, and after crimes acting, the purpose of a better and all around protection to the legal rights of the criminals may be achieved.
