Studies On The Legal Regulation Of Standard Form Contract Terms

Standard form contracts are widely used in our daily life.It is beneficial to reduce of transactional cost with its briefness and convenience. It makes the parties get rid of complicated contractual negotiations and put more energy into the operation and management of businesses.However,it has its drawbacks,witch violating the counterpart's interests always with its unfair terms.All countries are trying to improve the social justice while realizing the efficiency.It is a hard task that we should perfect the regulation of standard form contract in order to realize justice and protect consumers' lawful rights.The author analyses the standard form contract of buying car in daily life,and considers the problem.The first part expounds the concept,the legal character and the value of standard form contract,figuring out why we must regulate the standard form contract.The second part mainly discusses the problems on how foreign countries regulate the standard form contracts.The third and the forth part discusses the current legal regulation of standard form contracts in China,and gives some advice on how to improve it.
