Study On Bona Fide Acquisition In China

Bona Fide Acquisition means that in the circumstances of ex right disposition,the bona fide transferee may acquire the right of a thing when the requisite of public summons is satisfied.Bona Fide Acquisition is taken as a formal legal system in the Real Right Law of People's Republic of China firstly in March 2007.According to the regulations on Bona Fide Acquisition in Chinese law,this article studies,compares and analyzes the concept of Bona Fide Acquisition,theoretical foundation,value analysis, legislation conditions and result of Bona Fide Acquisition.Especially,I focus on discussing how to understand the meaning of Good Faith and judge it in practice,Bona Fide Acquisition of real estate and booty.This article consists of four parts.Part one describes the concept and legislation evolution of Bona Fide Acquisition and analyzes the function of Bona Fide Acquisition.Part two discuss the meaning and judging of Good Faith.Part three and four discuss Bona Fide Acquisition of real estate and booty respectively.
