Research On The System Of Innocent Acquirement

Innocent acquirement is a very important system of real right law. As the product of the economic development, it plays an important role in maintaining economic order and protecting trade safety, and is widely recognized by many countries. Our newly published Real Right Law establishes clear regulations for this system, filling the vacancy in our civil legislation. We can naturally understand the legal and research value of this system.Based on this understanding, this paper makes a comprehensive and systematic analysis for the historic development, theoretic contents, constitutive requisites, effective values of the innocent acquirement system, from the angle of foundation theory, structure theory and effect theory. This paper draws some important conclusions and makes certain evaluations on legislation.The Real Right Law passed on the March 16th , 2007 clearly presents this system. Based on the theoretic analysis, this paper analysis the constitutive requisites, including subject, subjective requirement, object, objective requirement, study our concrete legislation, and evaluate the relationship between the three involved parties and innocent acquirement of related real rights.
