The placement is a kind of new recruit and use style for agile employment,which has been an indispensable emerging field for our country's labor market.In practical,the placememt boosts the employment in some extent,meanwhile many problems expose to the public,which especially focus on labors' rights and interests issue.In theory,the theoretical field does not have the uniform recognization on the placement, and they lack adequate research on the legal stipulations and managements pattern on it.In legislation,before the law of the people's republic of China on employment contract come on,our country's legislation on the placement is nearly blank,the law of the people's republic of China on employment contract which has already come on has moderate legal stipulations and managements on the placement,but its system design has many disfigurements on legislation,which can not effectively protect the rights and interests of labors who are placed.Therefore,from the aim of the protection of labors and the integrity on the placement legislation,the writer takes the rights and interests protection of labors who are placed in our country as the research subject.Hope that through the comment of this paper,it could arise the extensive attention of the whole society,attach more importance on the rights and interests of labors who are placed,study on the placement system and legislation stipulations & managements more deeply,which can boost the optimization on the placement and the integrity on legislation,consequently protect the legal rights and interests of labors who are placed in our country from illegal infringement.From the actuality which the protection of rights and interests of labors placed is generally missing,this paper synthetically uses the research methods of induction and contrast analysis,and it develops its dissertation on the labors' rights and interests protection from the several points as below:Chapter one,this chapter begins from choices of the word of placement,it defines the basic meanings of placement and the legal relationships of the three parties.Then it makes a differentiate on the work forms of the three occupation which are easily confused,namely the contracting,occupation recommendation and human agency.Lastly,it summarizes the development situations on our country's present placement.Consequently it shows clearly the speciality on the rights and interests of labors who are placed and the need to legislation stipulations and managements on our country's placement.Chapter two,this chapter uses the rights & interests protection of labors who are placed as the basic clue,analyses and discusses the existent problems and the reasons which come into being on the rights and interests protection of labors who are placed in our country,consequently show clearly the problems which must to be resolved in reality of the legal stipulations and managements on placement in our country.Chapter three,this chapter uses the base of academic achievements on many domestic experts and specialists for reference,read and unscramble the related stipulations of rights & interests protection of labors who are placed as per our country's law of employment contract in detail,then through the contrast with the legislation experiences of overseas and Taiwan area on the placement,combine the problems on the labors' rights & interests protection of our country,it points out that disfigurement on the placement.Chapter four,this chapter aims at the problems in reality and the present legislation disfigurement,the writer proposes the legislation suggestions on perfecting our country's placement system,by which can improve the optimization on the comprehensiveness and effectiveness of placement legislation,consequently protect the legal rights and interests of labors who are placed in our country from illegal infringement.The last chapter is the conclusion of summarising the main standpoint in paper,clarify the purpose of writing this paper again.Maybe because the theoretical level and practical capability of the writer is limited,the writer does not make further and deeper study and research on the issues of placement,it is also the largest regret when the writer completed the paper.However,the writer wish could arise the extensive attention and discussion of the whole society through her shallow and simple standpoint,it can have much better functions than expected,in order to boost the further optimization and integrity of our country's placement system,thus it can effectively protect and fully remedy the rights & interests of labors who are placed.
