A Research On Civil Liability Of Construction Supervisor To Purchasers Of Commodity Apartment

With the application of the basic theories of laws, the thesis aiming to research the civil liability about construction supervisor to apartment purchasers, analyzed the impact of construction supervision party's behavior on apartment purchasers' interests, and some special complexion in the process of construction supervision on commodity apartment development. The article probed into some problems such as imputation principles and theoretical basis of liability about construction supervision party to apartment purchasers for the sake of apartment purchasers, then bridged construction supervision party and apartment purchasers with civil liability, in order to get a new cognition to construction supervision party's liability. The thesis consists of four following chapters:Chapter one is a brief account of construction supervision and definition of apartment flaws .The part, firstly introduce the definition of apartment flaws simply, and analyze defects of the measures to protect apartment purchasers, then construe the protection function of construction supervision to apartment party's interests to explain that strengthening supervision is a useful measure to protect apartment purchasers.Chapter two "reasons and countermeasures to nonfeasance of construction supervision party ".the part investigate some problems existing in nowadays construction supervision industry, analyze the reasons of nonfeasance, which involving law system, motivation.Chapter three" the basis on civil liability of construction supervision to apartment purchasers" with the theory of liability about specialist to the third party, this part analyze rationality and characters of the civil liability about construction supervision to apartment purchaser. Furthermore, this part point out two ways, which including tort and contract breaching, to impute construction supervision for apartment purchasers.Chapter four "imputation of liability" analyze some problems about the imputation principles and expound the way to prove cause and affect relationship and to prove the construction supervision party's fault.
