Improvement On China's Pardon System

Titled by "Improvement on China's Pardon System", this paper described the conception and classification of pardon system, and also the history of and comments on pardon system in China and abroad, now and past. The pros and cons of pardon system, rationality and practical needs about implementation of pardon system in China has been analysis, and then, on base of the front, the author discussed the improvement on China's pardon system.This paper, in addition to the preamble and the conclusion part, is divided into four chapters.The first chapter outlined pardon system. This chapter is divided into two parts. In the first quarter, the author proposed the definition of pardon system on base of comprehensive study on the definition of pardon system in the academic. In the second quarter, the author elaborated ancient and modern types of China's pardon system, the latter has been detailed.Chapter 2 described the development of the pardon system in and abroad. This chapter was divided into two. Subchapter 1 clued the history of China's pardon system to the emergence, the development in the feudal era and the establishment in modern society, and introduced the modern history of the pardon system in China's Hong Kong and Macao. Subchapter 2 presented the evolution of the pardon system in foreign country (mainly Western).Chapter 3 listed the pros and cons of pardon system, which is the focus of the full text. This chapter has three subchapters. Subchapter 1 listed evaluations on pardon system of domestic and foreign scholars. Subchapter 2 analyses the rationality of the pardon system. Subchapter 3 analysis the practical needs of China's pardon system.Chapter 4 discussed the improvement on China's pardon system. This chapter has three subchapters. Subchapter 1 described the status quo of China's pardon system, the features of seven special pardon. Subchapter 2 analysis the practice of seven special pardon in China, and some aspects on improvement of China's pardon system. Subchapter 3 proposed the legislative concept of improvement on China's pardon system on the basis of former.
