On The Application Of The Restraining Criminal Law In Cyberspace

We have lived in the world of network,and the future society will be full of information.The well-developed network not only brings people convenience,but also many difficult problems about the practice of law. The author holds that dealing with some alleged violation of law about cyberspace should be guided by the principle of the Restraining Criminal Law.This article probes into two kinds of online alleged violation(naked chat and human flesh search).First of all,the article analyzes the performance of new types of online alleged violation and the controversy about conviction.The author considers that dealing with such violation should follow the principle of the Restraining Criminal Law.Secondly,the article explores the Restraining Criminal Law's origin,content,value and influence to the classification of action and probes into the relationship between the Restraining Criminal Law and the protection of human rights.Thirdly,in the perspective of the Restraining Criminal Law,the article concretely analyzes how to characterize and dealing with such new violation.Lastly,the article proposes that dealing with such alleged violation should be guided by the principle of the Restraining Criminal Law.
