The pledge of patent is the only method of security for patent in our legal system,which is to guarantee the credit through the exchange values. The pledge of patent is an important composition of the pledge.When the pledge of patent is rising,we can say the patent system develops from the static usage to dynamic usage.Under such background,studying the pledge of patent has important meanings nowadays.This dissertation,with the method of historical analysis,logic analysis, comparative analysis,and positive analysis,starts with the conception of pledge,pledge of right.Through comparing the pledge of patent with other kind of right,this dissertation also focuses on the characteristics,and the trend of the pledge of patent,and looks for its accurate orientation.The author tries to analyze the problems in the practices in order to perfect the pledge of patent in our country.Comparing with the pledge of tangible property,pledge of patent is a new conception which makes great dispute.As some kind of information at heart,patent has the character of unexhausted and unexclusive.Anyone can use one patent,but can not possess one patent.As one kind of disclose methods,the registration can not make a distinction between pledge and mortgage.There are seven municipal governments issued rule of pledge of patent.But there are still some problems in the rules which could delay the development of patent pledge.So,I suggest the state lay down the law of pledge of patent in order to promote the development of pledge of patent.
